MEMBER

1)1) Employment Status



All members who are using the service as a Flexible worker for temporary shift cover, are agreeing to sign up to HMRC being self-employed. Last Minute Barstaff Ltd accepts no responsibility or liability concerning Last Minute Bar staff’s members tax affairs as they’re solely responsible for their tax affairs.

2) If you are using the service as Flexible worker, working on a invoice basis, you are entitled to at least £8.50 PH for using the service.

3) Partner Contact

As a Member of the last-minute bar staff platform, you are forbidden to contact the partners directly unless it’s through the messaging service on the website or App. if it’s an emergency and you’re phoning them to let them know you can’t attend a shift and you’ve already tried to contact them through the messaging service but you didn’t get a response. If you are found to be in breach of these terms you will be removed and banned from the platform.

4) As a Member of Last Minute Bar Staff’s platform, you must adhere to the Last Minute Bar staff partners rules and uniform requirements while covering a shift in their business, failure to do this will result in a poor rating from the partner.

5) If you’ve agreed to work a shift for any of our partners and you can’t attend that shift for whatever reason you must contact the bar or establishment immediately, the result of not doing this will be you getting a very poor rating from the Partner. If you miss three shifts in a one-month period, you will be removed and banned from using the platform.

6) When you’ve completed a cover shift at one of the Last Minute Bar Staff partners, You must use the invoice generator and submit you’re invoice to the partner within twenty-four hours of the completed shift to get paid within 7 days.

7) When registering to use the LAST MINUTE BARSTAFF platform, you must use your full legal name and you must be 18 years or older, if you are found to have lied or given fraudulent information about yourself, LAST MINUTE BARSTAFF limited will remove and ban you from the platform and reserves the right to take legal action against you. Upon registering for the platform you must be eligible to work in the United Kingdom.

8) When attending cover shifts, you must carry identification in the form of a passport or driving licence and show it to the manager upon arrival. Failure to do this will result in you being turned away from the establishment and this will affect your rating.

9.) If your shift is cancelled within six hours of the beginning of your shift you are entitled to invoice the partner for 50% of the hours of the total shift.

LAST MINUTE BARSTAFF LIMITED - Terms & Conditions Contingency

The conditions below serve to govern the online staffing solution undertaken by LAST MINUTE BARSTAFF Ltd (hereinafter known as “the Company”, “we”, “our” or “us”). “Partner” or “you” hereinafter refers to the company who commenced our services. The headings in these Terms and Conditions are for clarity only and shall not affect their interpretation.

Contractual Agreement

Commencement by the Client of any assignment(s) contractually commits the Client to the terms and conditions of LAST MINUTE BARSTAFF Ltd. No documentation or authorisation signed by the Client is needed to deem any assignment commenced. The Contract will be deemed to have commenced upon either:

• Verbal agreement of the Contract
• Written agreement of the Contract
• Clicking to agree on Company website upon sign up to use the service online

Fees

There is a four-tier payment system.

• Tier one being a monthly subscription for unlimited use of the service, this includes posting for last minute shift cover or planned shift cover and the option of employing our members full time. The fixed monthly fee is £50.00 per calendar month for a minimum of six months. NOTE: tier one subscription service is only available to bars, restaurants and pubs.
• Tier two is pay per post option and with this option you are limited to posting shifts in a post for last minute or planned cover but cannot employ our members full time. And the cost of the post will be £5.75 per position detailed in the listing.
• Tier three is also a pay per post option and with this option you are limited to posting shifts to employ our members on a permanent basis whether that be full or part-time. The cost of the post will be £23.00 per position detailed in the listing.
• Tier four is a token based system detailed on the site as ‘Shift Coins’ with one flexible listing (detailed in Tier 3) costing one ‘Shift Coin’ and one permanent listing (detailed in tier 4) costing 4 ‘Shift Coins’.

Payment for members

All our members are self-employed agents and are solely responsible for their own tax affairs. You must at least pay them the Last-Minute Bar Staff minimum hourly rate of £8.50/hour. At the end of each shift our members will submit an invoice for their services within 72 hours and it is your responsibility to pay them within seven days of the completed shift in payment method of your choice e.g. cash or bank transfer.

Charges

Late payment charges

Failure to deliver payment to our members within seven days of a completed shift will result in charges being applied to your account. You will receive an invoice from LAST MINUTE BARSTAFF LTD for 20% of the outstanding balance for everyday that the balance is left unpaid. Having paid an invoice, it is imperative that you login to your account to notify the company and member the invoice has been paid. This will stop any further charges being applied.

Shift Cancellation

Cancelling a shift within 6 hours of its start time will incur a charge of 50% of the total shift value. This will be received in the form of a member invoice for 50% total hours and hence total cost to be paid within 7 days of shift completion.

Aptitude, Damage, Injury Or Loss

Members – We rely on the good faith of our members and accept no responsibility for any false or inaccurate information or representation provided. Whilst every attempt is made by us to introduce satisfactory members to you, it is your responsibility to check the members identification upon arrival for temporary or fulltime roles in the form of a valid identification. We shall not be responsible for any damage, injury, loss or for the cost thereof to you. All our members are self-employed agents, and are not employees of LAST MINUTE BARSTAFF LIMITED, and nothing in their agreement nor this agreement shall be construed to create an employee employer relationship between the members and LAST MINUTE BARSTAFF Limited.

Terms

• If you are signed up to the subscription (the subscription is only available to pubs, bars and restaurants) , you have unlimited use of the service, you can as a partner use as many members as your business requires for temporary positions and you can also post jobs for fulltime positions.
• If you have no response to your post you will receive your next post for free.
• If you are found to be breaching the term of this contract and employing members full-time or part-time having not posted a full-time or part-time listing you will be liable to pay a penalty of £149.99
• All contact with our members has to remain on the website/app but in the event of technical issues which affects the messaging service and stops members and partners making contact, the use of telephone/email will be accepted.
• You also agree to give the member an accurate rating on performance after they’ve completed a cover shift.
• By agreeing to these terms, you will also allow LAST MINUTE BARSTAFF Ltd to use your company name and logo for promotion/marketing purposes in our newsletters, social media, advertisements and display your name and logo on our website/Application.

Governing Law and Jurisdiction

The contract and any dispute or claim out of or in connection with it or its subject matter shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of, or in connection with, the Contract or its subject matter.

We agree to this contract.
